Maharashtra Government issues the Draft Maharashtra Occupational Safety, Health and Working Conditions (Labour) Rules, 2026

The Maharashtra Government has issued the Draft Maharashtra Occupational Safety, Health and Working Conditions (Labour) Rules, 2026 (“Draft Rules”) under the Occupational Safety, Health and Working Conditions Code, 2020 (“Code”). Objections and suggestions to the Draft Rules, if any, may be addressed to the Labour Commissioner Maharashtra State, C-20, Block E, Bandra-Kurla Complex, Bandra East, Mumbai-400051 or by e-mail at: mh.labourcodes.rules@gmail.com, within a period of 45 days from the date of its publication in the Official Gazette, by 14th June 2026.
Key Proposals under the Draft Rules:
- Obtain registration by making an application electronically on the designated portal by giving details about the establishment, and uploading documents related to registration of the establishment, proof of identity and address of the employer(s).
- Lay down duties of employer which includes annual health examination of employees, letter of appointment, and notice of accidents, dangerous occurrences, and certain diseases.
- Establish Safety Committee for certain classes of establishments or factories and prescribe the qualifications and duties of Safety Officers of such Committee.
- Prescribe daily and weekly working hours, wages for overtime and compensatory holidays.
- Prescribe maintenance of registers of employees, attendance-cum-muster roll, as well as wages, over time and deduction, either electronically or otherwise.
- Prescribe display of notices showing the name and address of the establishment, hours of work, wage period, date of payment of such wages, details of accident and dangerous occurrence in the establishment for the last five years, etc, at the conspicuous place of the workplace of the establishment.
- Prescribe annual submission of a return to the Inspector-cum Facilitator by 1st February every year, relating to category of employees, health & welfare facilities retrenchment/ layoffs, bonus, maternity benefits etc.
- Conditions for grant of license to a contractor, procedure for issue of license, along with renewal of license have been specified.
- Prescribes provision of journey allowance for Inter-State Migrant Workers.
- Conditions for grant of license pertaining to beedi and cigar workers, procedure for issue of license, prescribed fees, and renewal of license have been specified.
- Prescribes provision of housing accommodation for workers and their family residing in a plantation as near as possible to the place of work.
- Prescribes provision of washing, bathing and cloak room facilities to the workmen who are employed in handling insecticides, pesticides, chemicals and toxic substances.
