Public comments invited on the proposed introduction of the Explosives Bill, 2025 till 17th July, 2025

With a view to repeal the Explosives Act, 1884 (“Act”) and re-enact a new legislation with necessary modifications including penal provisions, the Department for Promotion of Industry and Internal Trade (“DPIIT”) has invited comments on the proposed introduction of the Explosives Bill, 2025 (“Bill”). Comments/Suggestions (if any) may be submitted till 17th July, 2025.

Salient Features of the Bill:

  • The object, purpose, short title and commencement of the Bill has been proposed to be modified;
  • The terms proposed to be modified are-
  1. ‘aircraft’,
  2. ‘carriage’,
  3. ‘explosive’,
  4. ‘export’,
  5. ‘import’,
  6. ‘master’ and
  7. ‘district magistrate’.
  • The terms proposed to be added are-
  1. ‘licencing authority’,
  2. ‘chief controller’,
  3. ‘competent person’,
  4. ‘controller’,
  5. ‘operator’,
  6. ‘third-party inspection agency’ and
  7. ‘notification’.
  • The reference to the provisions of the Code of Criminal Procedure, 1973 and the Indian Penal Code, 1860 across the Act has been proposed to be substituted with provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023 and the Bharatiya Nyaya Sanhita, 2023 respectively;
  • Several provisions have been proposed to be rearranged and the provision relating to persons already in business in respect of certain explosives to carry on such business without licence for a certain period has been proposed to be removed owing to their transitional nature;
  • It has been proposed to insert new provisions with respect to the procedure of making an application for grant of licence and conditions for grant of licence;
  • Further, it has been proposed to modify the existing penalty and increase the fine for certain offences.
