Restaurants and eating houses in Madhya Pradesh get conditional exemption from opening and closing hours prescribed under the Madhya Pradesh Shops and Establishments Act

Government of Madhya Pradesh has clarified that opening and closing hours prescribed under Section *14 (1) of the Madhya Pradesh Shops and Establishments Act, 1958 (“Act”) will not apply to ‘Restaurants and Eating House’ located in the State of Madhya Pradesh subject to the following conditions:

  • Every employee is given one day holiday a week.
  • Employees will not be called for work for more than 48 hours in a week.

*Section 14 of the Act: Opening and dosing hours of restaurants and eating houses

 (1) Notwithstanding anything contained in any other enactment for the time being in force, no restaurants or eating-houses shall on any day be opened earlier than 5 a.m. and be kept open later than 1.30 a.m. for service :

Provided that an employee in such restaurant or eating-house may be required to commence work not earlier than 4.30 a.m. and shall not be required to work later than 2 a.m. :

 Provided also that any customer who was being served or waiting to be served at the closing hour of such restaurant or eating-house may be served in such restaurant or eating-house during the half hour immediately following such hour;
