Environment Ministry streamlines the procedure for utilization of sub-grade mineral generated from mining projects

The Ministry of Environment, Forest and Climate Change has streamlined the procedure for utilization of sub-grade mineral generated from mining projects holding a valid Environmental Clearance (“EC”).

Key Highlights:

1. For ongoing mining operations, the project proponent may utilize sub-grade mineral generated during ongoing mining operations within the existing EC capacity, subject to the following conditions:
   1. The approved Mining Plan includes the proposal for sub-grade mineral utilization.
   2. The sub-grade mineral is the same mineral for which the EC was granted.
   3. The cumulative quantity of mineral, including sub-grade mineral, produced, transported or utilized remains within the annual production capacity approved under the existing EC.
   4. The Project Proponent complies with all conditions of the EC, revised Mining Plan and applicable statutory provisions.

2. For utilization of legacy sub-grade mineral stocked within the lease area as per the approved mine plan, the project proponent may utilize the mineral within the existing EC capacity through an amendment to the existing EC. Additionally the following documents must be submitted:
   1. The approved mining plan incorporating the proposal for utilization of legacy sub-grade mineral.
   2. Confirmation that the sub-grade mineral is the same mineral for which the EC was granted.
   3. Ensuring that the cumulative quantity of mineral, including legacy sub-grade mineral produced, transported, or utilized during the ongoing mining period, remains within the annual production capacity approved under the existing EC.
   4. An Addendum to the EMP addressing environmental concerns arising from re-handling of legacy sub-grade mineral.
