Factories (Uttar Pradesh Amendment) Act, 2024 has been passed by the Uttar Pradesh Legislature; amends provisions relating to working hours of workers in factories across Uttar Pradesh

The Uttar Pradesh Legislature has passed the Factories (Uttar Pradesh Amendment) Act, 2024 (“Amendment”) with a view to amend the existing provisions of the Factories Act, 1948 (“Principal Act”) relating to working hours of workers in factories. The Amendment applies to the State of Uttar Pradesh and has gained effect on 3rd October 2025.
Key Highlights:
- The State Government, by virtue of a notification in the gazette, may allow factories of any specified group or class to extend the daily working hours up to twelve (including rest intervals), provided that total weekly hours do not exceed forty-eight. Such extension must require the worker’s written consent, and the remaining days of the week will be treated as paid holidays.
- The total working hours of a worker without an interval may be extended up to six hours in such factories, subject to conditions the State Government considers appropriate, in view of the flexibility allowed in working hours.
- The spread-over period may be extended up to twelve hours, including rest intervals, for any specified group or class of factories, subject to conditions the State Government considers appropriate, in view of the flexibility in working hours.
- In the principal Act, a worker who worked for more than nine hours in a day or forty-eight hours in a week was entitled to overtime wages at twice the ordinary rate. The Amendment has now introduced flexible working arrangements, allowing different daily limits based on the number of working days in a week, i.e. ten hours a day or forty-eight hours in a week for a five-day week, or eleven and a half hours a day for a four-day week. Overtime beyond these limits, or work done on paid holidays must be compensated at twice the ordinary rate of wages.
- The Amendment has increased the permissible overtime limit for workers from has been increased from 75 hours to 144 hours in a quarter. It has further introduced a new requirement that overtime work can only be assigned with the worker’s written consent.
