Government of Maharashtra proposes amendments to the Maharashtra Factories (Safety Audit) Rules, 2014; comments are invited till 18.04.2024

The Industries, Energy, Labour and Mining Department, Government of Maharashtra, has invited comments and suggestions on the draft to amend the Maharashtra Factories (Safety Audit) Rules, 2014 (“Drafts Rules”) by 18th April, 2024.

The comments and suggestions are to be submitted to the Director, Directorate of Industrial Safety and Health Kamgar Bhavan, 5th Foor, Block-E, C-20, Bandra-Kurla Complex, Bandra (E.), Mumbai 400 051.

Key Highlights:

  • The applicability criteria of the Act with respect to number of employees in a factory has been reduced from 250 to 50.
  • The definition of Safety Auditor has been broadened to include institutions recognized by the committee constituted by State Government to carry out safety audit in accordance to the rules.
  • The Draft Rules propose that after completion of internal audit, the occupier must submit the executive summary of observations and action taken report of the audit to the concern office of the Chief Inspector of Factories within thirty days from the date of completion of safety audit.
  • The eligibility criteria of safety officer is defined as a person who possess degree in Chemical, Electrical and Mechanical Branch and possessing the qualifications, experience or any other requirements as set out in Schedule I.
  • The occupier of the factory has to electronically inform the officer of Directorate of Industrial Safety and Health seven days in advance before the commencement of the safety audit.
