Organisations in Gurugram must submit Annual Report (for period 1.01.2021 to 31.12.2021) under POSH Act by 30.04.2022, non-timely submission will attract penalty of Rs. 50,000/-and strict action

In an Order dated 12th November, 2021, the Deputy Commissioner of Gurugram has fixed 30th April of every year as the due date for submitting the annual report by organisations in Gurugram (Government & Non-Government), as per calendar, about cases of harassment in the workplace, in compliance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 [Act].

 

Further to this, in another Order dated 8th December, 2021, the Addl. Deputy Commissioner of Gurugram has ordered organisations to submit their annual report for the period 01.01.2021 to 31.12.2021 about cases of harassment in the workplace by 30th April, 2022, through google form (link shared via e-mail).

 

Consequences of not submitting the annual report:

Every employer in default will be liable to pay a penalty of Rs. 50,000/-for failing to submit the annual report on time. In case of non-compliance, strict action will be initiated against the organisation as per the Act which includes the company to having its license cancelled / discontinue its business.

 

In view of the above, if you have offices in Gurugram, please check your e-mails where the google form link is shared and please go ahead and furnish the annual report by 30th April 2022. Alternatively, if you have not received the e-mail with the link please check with the Office of the Deputy Commissioner of Gurugram / Additional Deputy Commissioner of Gurugram.

 

Background:

Section 21 of the Act read with Rule 14 mandate the Internal Committee in each calendar year to prepare an Annual Report and submit the same to the employer and the District Officer. Non-submission of Internal Committee’s Annual Report leads to non-compliance of the Act which attracts a penalty of Rs. 50,000/- or double the sum and/or cancellation of business license.
