Public comments invited on Central Motor Vehicles (Draft Amendment) Rules by 13th February, 2022; proposes additional airbags for vehicles (falling under M1 category) manufactured after 1st October, 2022

The Transport Ministry has proposed further amendments to the existing Central Motor Vehicles Rules, 1989. Mandatory installation of additional airbags to vehicles manufactured after 1st October 2022 is proposed in the draft amendments. Objections and suggestions are invited on the draft amendments and the same will be considered on 13th February, 2022.

Key Highlights:
All vehicles under M1 category, manufactured after 1st October, 2022, will need to be fitted with two side air bags, one each for the persons occupying front row outboard seating positions and two side curtain / tube air bags, one each for the persons occupying outboard seating positions. Requirement for such airbags shall be verified with compliance to AIS-099 (amended from time to time), till the corresponding Bureau of Indian Standards (BIS) specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).
Note:
“Side/side torso air bag” means any inflatable occupant restraint device that is mounted to the seats or side structure of the vehicle interior, and that is designed to deploy in a side impact crash to help mitigate primarily torso injury and/or occupant ejection, for the persons occupying front row outboard seating positions. The side / side torso air bags can also deploy in other crash modes as determined by the vehicle manufacturer.
“Side curtain/tube air bag” means any inflatable occupant restraint device that is mounted to the side structure of the vehicle interior, and that is designed to deploy in a side impact crash or rollover to help mitigate primarily head injury and/or occupant ejection for the persons occupying the outboard seating positions. Such side curtain/tube air bags can also deploy in other crash modes as determined by the manufacturer”.

Vehicles manufactured on or after 1st April, 2021 to be fitted with airbag for the person
The Ministry of Road Transport and Highways (“MoRTH”) has amended the Central Motor Vehicles Rules, 1989 (“Rules”).
The amended Rule will be called the Central Motor Vehicles (Third Amendment) Rules, 2021 and the following provision has been introduced –

New vehicles manufactured on or after 1st April, 2021 will be fitted with airbag for the person occupying the front seat, other than the driver and such airbag will be as per AIS 145 (as amended from time to time).
For existing models, the above-mentioned requirement needs to be complied with from 31st August, 2021. |
