Public comments invited on the draft Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2023 by 1st July, 2023

The Ministry of Environment, Forest and Climate Change has proposed amendments to the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and has invited objections or suggestions by 1st July, 2023. The provisions of the draft amendment are slated to gain effect from 1st April, 2024.

Key Amendments Proposed:

  1. The draft Amendment includes a separate provision regarding the management and utilization of Used Oil and subsequently insert Schedule X specifying the Extended Producer Responsibility (“EPR”) for Used Oil;
  2. The draft Amendment proposes to define the terms such as ‘base oil’, ‘used oil’, ‘used oil importers’, ‘bulk generator’, etc.
  3. The manner of registration, the modalities of the EPR regime, the EPR targets for producers of base oil or lubrication oil and used oil importers, the process of generating EPR certificates, etc. are proposed to be incorporated in Schedule X;
  4. The proposed Schedule X also lays down the responsibilities of the various stakeholders such as Producers, Used Oil Importers, Collection Agents, etc. in addition to provisions regarding levying of Environmental Compensation along with other statutory penalties.
