Telangana Govt. grants conditional exemption to IT /ITeS shops and establishments in the State from provisions relating to working hours, opening and closing times etc.

The Governor of Telangana has granted an exemption to all Information Technology Enabled Services (ITES) and Information Technology Establishments in the State from provisions of the Telangana Shops and Establishments Act, 1988 for a period of four years until 30th May 2028 subject to specified conditions.

The provisions which are being exempted are as follows:

Section 15 – Mandates that establishments must not be opened or closed earlier than the hours prescribed by the Government

Section 16 – Stipulates a maximum of eight (8) hours of daily work and forty-eight (48) hours of weekly work;

Section 21 – Prohibits young persons from working in any establishment before 6:00 a.m. and after 7:00 p.m.;

Section 23 – Prohibits women from working in any establishment before 6:00 a.m. and after 8:30 p.m.;

Section 31 – Stipulates that every employee in any establishment is entitled to nine holidays per year with wages, including Republic Day (26th January), May Day (1st May), Independence Day (15th August), Gandhi Jayanti (2nd October), and Telangana Formation Day (2nd June).

Operation of the above-mentioned are exempted for Shops and Establishments in the State subject to the following conditions:

  1. Employees will have a 48-hour work week. Overtime wages are required for work beyond 48 hours;
  2. Employees are entitled to a weekly day off;
  3. Management can schedule young and female employees for night shifts if adequate security is provided during work hours and for transportation to and from their homes;
  4. Employees must receive identity cards and all welfare measures they are entitled to under current rules;
  5. Employees working on notified holidays must be given a compensatory day off with wages;
  6. Companies must collect biographical data and conduct background checks for all drivers, whether employed directly or through outsourcing, including details such as driving license, photographs, address, telephone No/Mobile No. etc.
  7. The company’s supervisory officer must set the schedule and routes for pick-up and drop-off every Monday (or the next working day if Monday is a holiday). Any changes in drivers, routes, or shifts due to emergencies must be communicated to supervisory officers and employees.
  8. Women’s mobile phone numbers and addresses must not be disclosed to unauthorized persons.
  9. Routes should be planned to ensure no woman employee is picked up first or dropped off last.
  10. It is recommended that the company provide security guards for vehicles during night shifts.
  11. Designated supervisors must randomly check vehicles on various routes.
  12. The company must have a control room or travel desk to monitor vehicle movements.
  13. The exemption granted by these orders may be revoked at any time without prior notice.
  14. The time after / before which security must be provided to women employees for cab drop offs / pickups should be specified. Suggested as before 6 am and after 8 pm.
  15. General exemption from maintenance of various statutory registers in hard copies and recognition of soft copy of Registers as sufficient compliance.
  16. If the above conditions are violated, the exemption orders issued to the company must be revoked by the Government at any time without prior notice.
  17. The conditions stipulated above will not be detrimental to the employees working in the said establishments.
  18. The Integrated Registers must be maintained and integrated Returns to be filed in terms of G.O.Ms.No.23, LET&F Department, dt:24.03.2016.
