Illegal Flexes/Advertisement Boards put up without prior permission must be removed, violators must be penalized, directs Kerala HC

The Kerala High Court has in a recent order dated September 18, 2018 has directed the removal of all illegal Large Flex Board/Bill Boards/Advertisement Boards which have been erected without taking proper permission from the Local Government Authorities and without payment of the necessary fees.

While passing the order, the Hon’ble Court commented that these illegal flexes and bill boards erected by persons/entities who had not taken any permission or paid a penny to the coffers of the Local Government Authorities had created a Byzantine Maze where one bill board was put on top of another without any proper method for its disposal. Due to this, a lot of inconvenience was being caused to general public as these bill boards were obstructing several roads and pathways. The Hon’ble Court went on to state that persons/entities should provide an undertaking/bond while seeking permission for erecting these bill boards and that a scientific method for disposal of these boards should also be created once they have served their purpose.

Further, the Hon’ble Court reiterated that this direction for removal of flexes/Advertisement Boards was not a blanket ban on all flexes/Advertisement boards and rather was call for regulation of erection of these flexes/advertisement boards. Thereafter, the Hon’ble Court appointed Sri. Harish Vasudevan as an amicus curiae (friend of the court) to look into the implementation of the order and directed that the matter be listed again on October 3, 2018 for further hearing.
