Assam Govt. notifies fresh directives to ease COVID-19 restrictions; owners of private establishments to ensure that only fully vaccinated people are allowed inside

The Assam State Disaster Management Authority (“Authority”) has notified that all COVID- 19 induced restrictions / guidelines issued previously stands withdrawn except the following:
Key Highlights:

• Owners of private establishments are required to ensure that only fully vaccinated people may enter their premises further,
• Shop owners should compulsorily keep sanitizers / hand wash in their shops. The shop owners are required to ensure maintenance of social distancing and adherence to COVID- 19 appropriate behaviour;
• Non-vaccinated people shall not be allowed entry in public places / spaces except hospitals. All citizens are required to carry proof of being fully vaccinated while visiting public places / spaces. The owners of public / private establishments shall be responsible for ensuring that only fully vaccinated entrants are allowed inside by way of checking their vaccination status, failure to do so shall attract penal action;
• The people who visit the places of public gathering shall strictly follow COVID- 19 appropriate behaviour namely wearing of masks, maintaining social distancing, regular hand washing and use of sanitizer at all places of public gathering for containment of COVID-19 virus. Any person defaulting to comply with the above- mentioned measures, shall be liable for criminal prosecution under the relevant laws;
• For the purpose of operationalization of educational institutions in offline mode, separate Standard Operating Procedure may be issued by Education Department;

Any person violating the above- mentioned measures shall be liable to be proceeded against as per provisions under Disaster Management Act, besides legal action under IPC and other legal provisions as applicable.
Any person not wearing face mask and / or spitting in public places shall be fined to the tune of Rs.1000 which can be imposed by District wise Task Force comprising of District Disaster Management Authority, Magistrates, Police, Enforcement wing of District Transport Officer and Enforcement wing of Guwahati Municipal Corporation in their respective jurisdictions.
