CPCB invites comments on draft guidelines for EPR Trading Platform for plastic waste management

Central Pollution Control Board (“CPCB”) has invited comments on the draft Guidelines on authorization of EPRETPPP Operator and Functioning of EPRETPPP (“Draft Guidelines”) under the Plastic Waste Management (PWM), Rules, 2016. The Draft Guidelines proposes the guidelines for authorization of Extended Producer Responsibility Electronic Trading and Settlement Platform for Plastic Packaging (“EPRETPPP”) and its functioning.

Comments/suggestions on the Draft Guidelines may be sent to the Divisional Head, UPC-II, CPCB, Delhi, preferably through email: pwm.cpcb@gov.in with the subject title: “Comments on draft guidelines for EPR Trading Platform” by 12th September, 2024.

Key Highlights:

  1. The Draft Guidelines proposes the eligibility criteria for appointment of Electronic Trading Platform (“ETP”) to become EPRETPPP operator which includes general criteria, financial criteria and technological criteria. Further, it proposes ETP provider not to be debarred/blacklisted by any Govt. sector/ PSUs/ bilateral and multilateral agency.
  2. Proposal to not empanel organizations as ETP Provider falling under PIBOs or PWPs categories. Further, organizations having more than 50% ownership by equity, directly or through common directors in PWPs or PlBOs not to be empanelled.
  3. The proposed limits of shareholding for PIBO/PWP in ETP.
  4. Proposal to provide real-time dissemination of trade information within specified time to ensure transparency in the platform and to comply with international standards such as ISO/IEC 27001 for Information Security Management.
  5. Proposal for ETP provider to execute the operations directly or through its group company/associate company.
  6. Proposal to introduce various functions of EPRETPPP.
  7. Producer, Importer, Brand Owner Plastic Waste Processors engaged in recycling, waste to energy, waste to oil, and industrial composting and Local Bodies are proposed to trade on the EPRETPPP is proposed.
  8. Proposal to code all users as stated above into different categories as per their role (Buyer/ Seller) on the EPR Portal.
  9. Proposal of introduction of categories of EPR certificates.
  10. Proposed introduction of Price discovery mechanism for EPR Certificates.
  11. Proposal to introduce mechanism for settlement of trades between the buyers and sellers.
  12. Proposal to use electronic trading system and telecommunication network by ETP and to conduct audit, have cyber security framework etc.
  13. Proposal to introduce annual registration charge to be paid by ETP operator. Further, proposal to charge transaction fee from buyer and seller from ETP is introduced, such fee to be remitted to regulator.
  14. Dissemination of information by ETP operator on various parameters is proposed to be introduced.
  15. Proposal to provide Grievance Redressal Mechanism by ETP operator.
  16. Proposal to submit exit scheme by ETP operator in the event of closure.
  17. Proposal to develop and implement a prudent risk management framework by ETP operator.
  18. Proposal to submit annual report by ETP operator.
  19. Proposal to renew authorization after a specified period of time by ETP operator.
