Department of Consumer Affairs amends the Legal Metrology (General) Rules, 2011; amendment is effective 03.03.2021

The Ministry of Consumer Affairs, Food and Public Distribution, has, in an official gazette dated 3rd March, 2021, amended the Legal Metrology (General) Rules, 2011 (“Principal Rules”). The Amendment is called the Legal Metrology (General) (Amendment) Rules, 2021 ( “Amendment Rules”).

 

The Amendment is effective 03.03.2021.

 

The following are the comparative analysis :

(1) Every weight or measure used or intended to be used in any transaction or for protection of living beings or things in clause (k) of Section 2 shall be verified and stamped by the Legal Metrology Officer in the State in which such weight or measure is put to use and shall be re-verified and stamped at periodical intervals.

 

(2) The re-verification shall be carried out on the completion of a period of, –

(a) twenty four months for all weights, capacity measures, length measures, tape, beam scale and counter machine,

(b) sixty months for storage tanks, and

(c) twelve months for all weight or measure including tank lorry other than that mentioned in clauses (a) & (b).

 

 

(3)  Notwithstanding anything contained in sub-rule (2) every weight or measure which has been verified and stamped in situ shall, if it is dismantled and re-installed before the date on which the verification falls due shall be duly re-verified and stamped, before being put into use.

 

 

(4) Notwithstanding anything contained in sub-rule (1) every weight or measure which has been verified and stamped shall, if it is repaired before the date on which the verification falls due shall be duly re-verified and stamped before being put into use.

 

 

27. Periodical verification of weights or measures. –

 

(1) Every weight or measure used or intended to be used in any transaction or for protection of living beings or things in clause (k) of Section 2 shall be verified and stamped by the Legal Metrology Officer in the State in which such weight or measure is put to use and shall be re-verified and stamped at periodical intervals.

 

(1)   Every weight or measure used or intended to be used in any transaction or for protection of living beings or things in clause (k) of section 2 shall be verified and stamped by the legal metrology officer of the State of manufacture or import or at the place of installation as specified in clause (iv) of sub-rule (5) and be re-verified and stamped at periodical intervals by the legal metrology officer in the State in which such weight or measure is put to use.

 

2) The re-verification shall be carried out on the completion of a period of, –

(a) twenty four months for all weights, capacity measures, length measures, tape, beam scale and counter machine,

(b) sixty months for storage tanks, and

(c) twelve months for all weight or measure including tank lorry other than that mentioned in clauses (a) & (b).

 

Provided that such weights or measures which are used by the industries for their internal use and which do not affect the quantity delivered to the consumers or are not used in any transaction or for protection, shall not require such re-verification.

 

(3)  Notwithstanding anything contained in sub-rule (2) every weight or measure which has been verified and stamped in situ shall, if it is dismantled and re-installed before the date on which the verification falls due shall be duly re-verified and stamped, before being put into use.

 

 

(4) Notwithstanding anything contained in sub-rule (1) every weight or measure which has been verified and stamped shall, if it is repaired before the date on which the verification falls due shall be duly re-verified and stamped before being put into use.

 

(5)   For adopting a uniform procedure throughout the country and to avoid double stamping of the same weights and measures, the first time verification and stamping of weights and measures, sent from one State to another State, shall follow the following procedure, namely:- (i)    all types of weights and measures and such weighing and measuring instruments which are not required to be installed or calibrated at the place of use shall be verified in the State of manufacture or import; (ii)   all types of weights and measures meant for domestic use shall be verified in the State of manufacture or import; (iii)  all non-automatic weighing instruments, up to maximum capacity of 50 kg shall be verified in the State of manufacture or import, if it is not dismantled or do not require calibration before putting into use; (iv)  all other weights and measures and such weighing and measuring instruments which are required to be installed or calibrated at the place of use shall be verified and stamped at the place of installation.

 

1. As per the Amendment, every weight or measure used or intended to be used in any transaction or for protection of living beings or things will have to be verified and stamped by the legal metrology officer of the State of manufacture or import or at the place of installation and again reverified and stamped at periodical intervals by the legal metrology officer in the State in which such weight or measure is put to use.

 

2. Weights or measures which are used by the industries for their internal use and which do not affect the quantity delivered to the consumers or are not used in any transaction or for protection, shall not require re-verification.

 

3. Certain procedures need to be followed to maintain a uniform procedure throughout the country and to avoid double stamping of the same weights and measures. The first time verification and stamping of weights and measures, sent from one State to another State, will have to comply with these procedures as laid down in this Amendment.

Part-6 – Fabric or Plastic Tape Measure

 

3. Nominal lengths

Fabrics or plastic tape measures shall be made in nominal lengths of 0.5 m, 1 m, 1.5 m, 2 m, 3 m, 4 m, 5 m or multiples of 5 metres, provided that the maximum nominal length shall not exceed 100 metres.

Fabrics or plastic tape measures shall be made in nominal lengths of 0.5 m, 1 m, 1.5 m, 2 m, 3 m, 4 m, 5 m or multiples of “5 m, 5 m, 7.5 m, 10 m or multiples of  5 metres, provided that the maximum nominal length shall not exceed 100 metres.

 

 

The Fabric or plastic tape measurement will be 0.5 m, 1 m, 1.5 m, 2 m, 3 m, 4 m, 5 m, 7.5 m, 10 m or multiples of  5 metres and should not exceed 100 metres.

Part 7 – Steel Tape Measures

 

3. Nominal lengths

The tape measures shall be made in nominal lengths of 0.5 m, 1 m, 1.5 m, 2 m, 3 m, 4 m, 5 m or multiples of 5 m, provided that the maximum nominal length not exceed 200 m

Part 7 – Steel Tape Measures

 

3. Nominal lengths

The tape measures shall be made in nominal lengths of 0.5 m, 1 m, 1.5 m, 2 m, 3 m, 4 m, , 5 m or multiples of 5 m, 7.5 m, 10 m or multiples of 5 m, provided that the maximum nominal length not exceed 200 m

 

 

The Steel Tape measurements must be of 0.5 m, 1 m, 1.5 m, 2 m, 3 m, 4 m, 5 m, 7.5 m, 10 m or multiples of 5 m and should not exceed 200 metres.

Under the Seventh Schedule, the provision of minimum 500 metres rail track length should be available with a gradient of not more than 1:400 on either side of the rail weighbridge has been done away with.
