The Food Safety and Standards Authority of India (“FSSAI”) has, through a Notification dated 1st January 2020, has decided to further extend the timeline for compliance of labelling provisions for the products “Frozen Dessert or Confection with added Vegetable Oil / Fat and / or Vegetable Protein” as per the FSS (Food Products Standards and Food Additives) Thirteenth Amendment Regulations, 2017.
Background:
The FSSAI had, by a Notification [F. No. A-1(1)/Standards/MMP/2012] dated 12th October 2017, notified the Food Safety and Standards (Food Products Standards and Food Additives) Thirteenth Amendment Regulations, 2017 (“Amendment Regulations”), which prescribed revised standards for milk and milk products. A transition period of 6 months, i.e., upto 1st July 2018, was given to food business operators to comply with the revised guidelines. Subsequently, the timeline for compliance of labelling requirements for the products “Frozen Dessert or Confection with added Vegetable Oil / Fat and / or Vegetable Protein” was extended till 1st January, 2019 [please find attached] and then till 1st July, 2019 and 1st January, 2020, respectively .
Now, considering the fact that the issue of nomenclature of frozen dessert is still under review, representations were received for further extension of the timeline to implement the requirements. After considering the representations, FSSAI has decided to further extend the timeline of implementation till its final decision on the nomenclature of frozen dessert.
However, the Food Business Operators are required to comply with all other standards/labeling provisions specified for the said products under the regulations.
