In a Notification dated 22nd September, 2020, the Food Safety and Standards Authority of India (“FSSAI”) has issued a direction stating that the Government of India (“GOI”) has directed FSSAI to prohibit the blending in of mustard oil and facilitate manufacturing and sale of pure mustard oil for domestic consumption in public interest.
Background:
In light of this direction, reliance was placed on the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, where standards of blended edible vegetable oil permit an admixture of any two edible vegetable oils where the proportion by weight of any edible vegetable oil used in the admixture is not less than 20%. Further Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011 (“Point of Sales Regulation”) also permit such admixture.
The draft amendment to the Point of Sales Regulation, namely the Draft Food Safety and Standards (Prohibition and Restrictions on Sales) Amendment Regulations, 2020 (“Draft Regulations”) cover the above direction of GOI.
Since the Draft Amendment is in process of being finalized, FSSAI has therefore decided to operationalize the same with effect from 1st October, 2020.
