Karnataka Government notifies Bruhat Bengaluru Mahanagara Palike and Certain Other Law (Amendment) Act, 2023; fixes fees for approval and sanctioning and penalty for certain violations

The Karnataka Government has notified the Bruhat Bengaluru Mahanagara Palike and Certain Other Law (Amendment) Act, 2023 (“Amendment Act”) to further amend the Karnataka Municipal Corporations Act, 1976 (“Principal Act”). The Amendment Act inserts new definitions and revision of various fees.

Key Highlights:

  1. The Amendment Act inserts new definitions such as Ground Rent, Guidance Value and Scrutiny fee.
  2. The Amendment Act fixes fee charged or levied by the Commissioner for approving or sanctioning the plan or grant of commencement certificate or completion certificate, in the following circumstances:
  3. Fee for Issuance of license- Such rate not exceeding 0.30 percent of guidance value of vacant site under the provisions of Karnataka Stamp Act, 1957 multiplied by proposed built up area.
  4. Scrutiny Fee- Such rate not exceeding 0.10 percent of guidance value of vacant site under the provisions of Karnataka Stamp Act, 1957 multiplied by proposed built up area.
  5. Fee for maintenance usage of public roads, storing of construction materials in public places etc.- Such rate not exceeding 0.25 percent of guidance value of vacant site under the provisions of Karnataka Stamp Act, 1957 multiplied by proposed built up area.
  6. Security Deposit- As specified in zoning regulation for ensuring that the construction is in accordance with the plan sanctioned.
  7. Fee for commencement certificate- Such rate not exceeding 0.20 percent of guidance value of vacant site under the provisions of Karnataka Stamp Act, 1957 multiplied by proposed plinth area.
  8. Fee for occupancy certificate- Such rate not exceeding 1.0 percent of guidance value of vacant site under the provisions of Karnataka Stamp Act, 1957 multiplied by proposed built up area.
  9. Other fees as specified by the Government from time to time.
  10. Fixation of penalties for the following violations:
  11. For not obtaining commencement certificate- Such rate not exceeding 0.25 percent of guidance value of vacant site under the provisions of Karnataka Stamp Act, 1957 multiplied by proposed built up area.
  12. Penalty for regularization up to 5 percent of violation or deviation in the construction- Such rate not exceeding 35 percent of guidance value of the vacant site under section 45B of the Karnataka Stamp Act, 1957 multiplied by the violated portion.
