Title: Labour and ESI Department of Odisha formulates Self Certification Scheme for Startups under Ease of Doing Business
The Labour and E.S.I. Department of Odisha (“Department”) has formulated the Self Certification Scheme (“Scheme”) to promote Startups in the State of Odisha in pursuance of Ease of doing Business. The aim of this scheme is to protect the interest of workers and employees, by making the employer or entrepreneur voluntarily follow all the laws covered under this scheme.
The Key Highlights of the Scheme are as follows:
- The Startups registered under Startup Odisha initiative can opt for the Scheme by making an online application through the portalstartupodisha.gov.in.
- The establishments under the scheme will be allowed to submit self-certified returns for the laws under the scheme.
- The establishments under the scheme will be required to submit an online self-declaration and such establishments in its first year would not be inspected under any of the laws under the scheme.
- The establishments in its second year and up to 3 years from its setting up will not be inspected by the inspecting officer unless very credible and verifiable complaint of violation is received in writing and the approval is granted by at least one level senior to such inspecting officer.
The Scheme covers the following laws:
(i) The Building and Other Construction Workers (Regulation of Employment and Condition of Service) Act, 1996.
(ii) The Inter-State Migrant Workmen (Regulation of Employment and Condition of Service) Act, 1979.
(iii) The Payment of Gratuity Act, 1972.
(iv) The Contract Labour (Regulation and Abolition) Act, 1970.
