Department of Labour Employment and Training, Jharkhand (“LETJ”) proposing to amend the Bihar Child Labour (Prohibition and Regulation) Rules 1995 (“Principal Rules”), has issued the draft of Jharkhand Child Labour (Prohibition and Regulation) Amendment Rules, 2018 (“Draft Rules”) in accordance with the power to make State rules under the Child Labour (Prohibition and Regulation) Act, 1986.
The Government of Jharkhand has rolled the Draft Rules in line with the amendment brought in by Central Government in 2017 in the Child Labour (Prohibition and Regulation) Rules, 1988 where the words “Child Labour” has been substituted by the words “Child and Adolescent Labour”.
- In accordance with the power to make State rules under the Child Labour (Prohibition and Regulation) Act, 1986, LETJ has issued the draft of the Jharkhand Child and Adolescent Labour (Prohibition and Regulation) Amendment Rules, 2018.
- Establishment of a Child and Adolescent Rehabilitation Fund according to section 14B of Child Labour (Prohibition and Regulation) Act, 1986 is proposed.
- The Draft Rules have inserted a new provision dealing with payment of amount to child or adolescent from and out of Child and Adolescent Labour Rehabilitation Fund
- As per the Draft Rules, on certain circumstances when any amount is recovered by way of fine or order of Court or by any other means, such amount is to be paid to the child or adolescent in whose favour such amount is credited by following this rule.
- For the purpose of sub-rules dealing with health and safety and hours and periods of work, the word “children” is proposed to be substituted by the word “adolescents”.
