Labour Ministry extends the provisions of the Central Employee’s Provident Funds and Miscellaneous Provisions Act, 1952 to establishments with 10 persons or more in Jammu and Kashmir; w.e.f. 01.01.2020

The Central Ministry of Labour and Employment (“Ministry”), has through a notification dated 31st October, 2019 extended the provisions of the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 (“Central Act”) to the State of Jammu and Kashmir.

Now, establishments employing 10 or more persons and those previously covered by the Jammu and Kashmir Employees’ Provident Funds and Miscellaneous Provisions Act, 1961 will fall within the purview of the Central Act.

 

Background:

  • The Jammu and Kashmir Act previously covered establishments having 5 or more employees. Now with this notification, establishments employing 10 or more persons will be governed under the Central Act.
  • The Jammu and Kashmir Reorganization Act, 2019, published on 9th August, 2019 in the Official Gazette repealed the Jammu and Kashmir Employees’ Provident Funds and Miscellaneous Provisions Act, 1961 as provided in Serial No. 43 in Table 3 of the Fifth Schedule of the Jammu and Kashmir Reorganization Act, 2019.
