The Industries, Energy and Labour Department of Maharashtra has published a draft amendment (“Draft”) to further amend the Employee’s Compensation Act 1923 (“Act”).
As per the Draft, the Department has proposed to include the following under Schedule II of the Act:
“(L) employed in any capacity, directly or through any agency in any shop or establishment to which the provisions of the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017 (Mah XV of 2017) applies.”
Note: Schedule II of the Act contains a list of persons who are included in the definition of employees under the Act.
