The Ministry of Corporate Affairs (“MCA”) has, in a General Circular dated 27th June, 2019 issued information regarding filing of e-form DIR-3 KYC under Rule 12A of the Companies (Appointment and Qualification of Directors) Rules, 2014 (“Rules”).
The MCA has proposed that persons, who have already filed DIR-3 KYC, would only be required to complete their KYC through a simple web-based verification service, which will be pre-filled with data, based on the records present in the registry of the government, for ease of verification by such persons concerned.
The MCA, however, has clarified that in case anyone intends to update his/her details, the following process has to be followed:
- for updating mobile no. or e-mail address, such person would be required to again file e-form DIR-3 KYC, as the facility of updation is not proposed in the web-based service.
- for updating any other personal detail, e-form DIR-6 has to be filed for updation of the same before completion of KYC through the web-based service.
Background:
The MCA had received representations from stakeholders expressing certain difficulties in filing e-form DIR-3 KYC as per the Rules. Requests were also received for extension of period for filing such form. The MCA examined the representations received and issued this General Circular.
The MCA has also informed that the amendment in the relevant rules including the amendment related to extension of time for completion of KYC through e-form DIR-3 KYC or the web-based service would be notified shortly and has advised stakeholders to take note of the same and file according to the revised notification.
