Ministry of Communications revises exemption list for licensing requirement of low power and very lower power short range radio frequency devices or wireless equipment

The Ministry of Communications (“Ministry”) has notified amendments to the Use of Low Power and Very Low Power Short Range Radio Frequency Devices (Exemption from Licensing Requirement) Rules, 2018 on 10th May, 2024. The amendment is effective immediately.

The Ministry has amended Rule 3 to make specific exclusions for Transport and Traffic Telematics devices, (listed under “Table – VIII”) and has modified the frequency range in the Non-Specific Short Range Device, noted under “Table – IX” at Serial No. 14, modifying it from 24.15-24.25 GHz to 24.00-24.25 GHz through this amendment.

The amendment further clarifies that Equipment Type Approvals (ETAs) issued for specific models listed in these tables prior to the amendment will remain valid until the end of the life span of those models. This ensures that previously approved models are unaffected by the changes introduced by the amendment.

Background: Rule 3 states that individuals or entities adhering to the technical specifications outlined in Tables I to IX of the Rules are exempt from obtaining a license for various activities related to low power and very low power short-range radio frequency devices or wireless equipment.
