The Ministry of Environment, Forest and Climate Change (“MOEF”) has, through an Office Memorandum dated September 10, 2018, issued a set of Guidelines for Regulation and Monitoring of Imported Petcoke (“Guidelines”) in India. These Guidelines have been into force since September 10, 2018.
The Director General of Foreign Trade (“DGFT”) had prohibited the import of Petcoke for use as a fuel by an earlier notification dated August 17, 2018. However, these Guidelines permit the import of Petcoke for use in industries like cement, lime kiln, calcium carbide and gasification for use as feedstock or in the manufacturing process provided the following conditions are followed:
- Petcoke importing industries such as cement, lime kiln, calcium carbide and gasification must obtain consent of and registration with the State Pollution Control Board (SPCB) or Pollution Control Committes (PCC).
Note- The consent issued by such SPCB/PCC will specify the quantity permitted for import and its use on per month and per annum basis.
- Only the registered units that have obtained valid consent from the concerned SPCB/PCC can import Petcoke directly. The consignments must be in the name of the user industrial units only and must only be used by them.
- Importation of Petcoke for trading purpose is prohibited.
- The Authorised Importers must furnish the opening and closing stock of imported Petcoke to the concerned SPCB/PCC on a quarterly basis.
