MoEFCC amends Ozone Depleting Substances Rules, 2000 preponing the phase out time for pre-blended polyols and including them under pre-polymers; effective since 1st January, 2020

The Ministry of Environment, Forest and Climate Change (“MoEFCC”), through a notification dated 31st December, 2019 has amended the Ozone Depleting Substances (Regulation and Control) Rules, 2000 (“Principal Rules”), with effect from 1st January, 2020.

Key Highlights:

 

  1. Issuance of license for import of HCFC-141b (Hydrochlorofluorocarbon-141b) will be stopped from 1st January 2020.
  1. The phase-out date for manufacture of pre-blended polyols has been preponed from 1st January, 2022 to 1st January, 2020. The date of 1st January, 2022 was set by the Ozone Depleting Substances (Regulation and Control) Amendment Rules, 2014 (“2014 Amendment Rules”).
  1. With this amendment, the MoEFCC has included  pre-blended polyols under pre-polymers. Under Schedule VII of the Principal Rules, Pre-polymers are included as a product containing ozone depleting substances for which regulations of import and export have been put in place by the 2014 Amendment Rules.
