Night curfew implemented in the NCT of Delhi from 10 pm – 5 am till 30th April, 2021; movement of persons related to certain commercial and private establishments allowed subject to possession of e-pass

The Delhi Disaster Management Authority (DDMA) has imposed Night Curfew on the movement of individuals in NCT of Delhi with immediate effect (from 10:00 pm to 05:00 am) upto 30th April, 2021.

 

Key Highlights:

 

Exemption:

 

Individuals / persons engaged with the following are exempted from the above-mentioned restrictions:

 

1. Private and commercial establishments providing the following services:

 

  • manufacturing units of essential commodities;

 

  • production units or services, which require continuous process;

 

  • telecommunications, Internet services, broadcasting and cable services, IT and IT enabled services; print and electronic media;

 

  • delivery of all essential goods including foods, pharmaceuticals, medical equipment through e-commerce;

 

  • banks, insurance offices and ATMs;

 

  • power generation, transmission, distribution units and services;

 

  • cold storage and warehousing services;

 

  • private security services;

 

2. Persons who are going for COVID-19 vaccination;

 

The above-mentioned exceptions are allowed only with the possession of e-pass (in soft or hard copy), which may be obtained by applying on the website www.delhi.gov.in.

 

Note: The concerned District Magistrates shall be responsible for issue of e-passes for above-mentioned activities and for overall implementation of these measures in their respective jurisdiction.

 

3. Public transport such as Delhi Metro / public buses / autos/ taxis allowed to ply within its stipulated time for the transportation of only above mentioned categories of people during night curfew, as per prescribed protocols / SOPs issued by Government in this regard.

 

In case of violations, defaulting person(s) shall be proceeded against as per the provisions of Disaster Management Act and the Indian Penal Code along with other applicable laws.

 

Background

 

Earlier, the DDMA had applied the Ministry of Home Affairs (“MHA”) Order no. 40-3/ 2020 dated 27th January, 2021 (Guidelines for Surveillance, Containment and Caution) up to 28th February, 2021 and further extended the same upto 31st March, 2021 in the NCT of Delhi. The situation of COVID-19 has been reviewed and it was decided through an Order dated 27th March, 2021 to extend the time period with regard to permissible/prohibited activities till 30th April, 2021.

 

However, ceiling was prescribed on the number of persons in marriage, banquet hall, other gatherings / congregations and in funeral / last rites in NCT of Delhi:

 

a) In marriages, banquet hall, other gatherings / congregations:- ln closed spaces, a maximum of 50% of the hall capacity will be allowed with a ceiling of 100 persons and in open spaces, numbers will be allowed keeping the size of the ground/ space in view, with a ceiling of 200 persons subject to strict observance of wearing of face masks, maintaining social distancing, provision for thermal scanning and use of hand wash or sanitizer.

 

b) In funeral / last rites related gatherings / congregations:- Maximum 50 persons are allowed in funeral / last rites related gatherings / congregations subject to strict observance of wearing of face masks, maintaining social distancing, provision for thermal scanning and use of hand wash or sanitizer.
