In a Circular dated 27th November, 2019 the Karnataka State Pollution Control Board (“KSPCB”) has issued a an addendum to its Notification (“Principal Notification”) dated 11th March, 2016 dealing with ban of plastics.
Background:
The Principal Notification was issued banning the use, manufacture and sale of plastic carry bags.
Subsequently, a Corrigendum (dated 4th April, 2018) to the Principal Notification was issued wherein the definition of “plastic bags” was added as bags made from plastic material or compostable plastic material used for the purpose of carrying or dispensing commodities but does not include bags that constitute/ form an integral part of packaging in which goods are sealed prior to use.
Now, through the recent Circular (as an addendum to the Principal Notification) the definition of plastic bags is altered to exclude bags that form an integral part of packaging where goods are sealed prior to use at any manufacturing or processing unit.
