Government of Rajasthan has granted an exemption to all shops and commercial establishments within the state from the mandatory closure requirement outlined in *Section 12(1) of the Rajasthan Shops and Establishment Act 1958 (“the Act”). This exemption shall remain effective for a period of three years from the date of publication of notification i.e., 15-04-2024, provided that employers adhere to the following conditions:
- Weekly Paid Holidays: Employers must grant a weekly paid holiday to all employees, rotating the day off among them.
- Working Hours: The standard working hours for employees shall be fixed at 9 hours per day and 48 hours per week. In instances where additional work is necessary beyond the stipulated hours, employers must maintain separate records accordingly.
- Overtime Compensation: Employers are required to compensate employees for any overtime work in accordance with the provisions outlined in the Act.
- Appointment Letters: Employers must issue appointment letters to all employees.
However, it is to be noted that any violation of the aforementioned conditions by an employer of any shop or commercial institution will render this exemption null and void. In such cases, the employer shall be held liable for legal actions as prescribed under the Act.

*Section 12(1) of the Rajasthan Shops and Establishment Act: Weekly holidays. – (1) Every establishment shall remain closed for one day of the week. The employer shall fix such day at the beginning of the year, notify it to the Inspector and specify it in a notice prominently displayed in a conspicuous place in the shop or commercial establishment.
