The Tamil Nadu Government, through the Office of the Inspector General of Registration, has notified the Tamil Nadu Registration (Identity Verification for the Registration of Documents) Rules, 2018 (“Rules”) under the Registration Act, 1908 (“Act”)
The Rules provide persons with the option of Consent based Aadhar Authentication Services:
- while presenting documents for registering (section 32 of the Act)
- while appearing before sub-registrar for enquiry (section 34 of the Act)
- in case of examination for the satisfaction of registrar or for any other purpose specified in the Act (section 35(2) of the Act)
Consent based Aadhar Authentication Service has been defined as “authentication carried out by the Unique Identification Authority of India (UIDAI) or agencies appointed by it, after matching the biometric information of an individual at his request or his with his consent, with the information maintained by the UIDAI in its own central servers, and includes a ‘Yes/No’ response or a response containing the demographic information and photograph of the individual.”
The procedure that the registering officer must follow in the event the option of Consent based Aadhar Authentication Services is utilised, is clearly defined and the Rules ensure that the Aadhar details of persons opting for such service are verified with the UIDAI. On verification the system returns the Consent based Aadhaar Authentication Data to the person/user, while the information is printed in the summary reports and stored in the appropriate electronic format. Such verification shall serve as sufficient identification of the concerned person for the purpose of the Act.
