Supreme Court orders issuance of fresh notification for minimum wage rates in Delhi; rates as per March 3, 2017 notification to apply during pendency of proceedings

Subsequent to the Judgement, dated August 4, 2018 passed by the High Court at Delhi, invalidating the minimum wages notification No. F.Addl.LC/Lab/MW/2016 dated March 3, 2017 (“notification”)  issued by the Government of National Capital Territory, Delhi  (“Delhi Government”) , the Delhi Government had approached the Supreme Court (“Court”) by way of a Special Leave Petition (“SLP”) challenging the said judgement.

Upon hearing the SLP on October 31, 2018 the Court has issued an order upholding the validity of the said notification till the final Judgement in the matter is passed. The Delhi Government has been directed to revise the minimum wages accordingly and place the same before the Court for its consideration within a period of 3 months from the date of order i.e. by January 31, 2018.

The Court has clarified that as of now no arrears need to be paid on the wages. The question of arrears will be decided according the fresh notification that will be issued. Further, no recovery of amount paid shall be made by the employer.
