The State Level Environment Impact Assessment Authority, West Bengal (“SEIAA”) has, through a notification dated 30th October, 2018 announced that now onwards, entities or individuals initiating, or proposing to initiate building and construction projects (“project proponents”) must fill up the Checklists A and B (Checklist A provides the list of documents to be submitted along with Form 1 and Form 1A for obtaining Environmental Clearance {“EC”} and Checklist B provides the list of documents for stipulating conditions related to EC) and provide copies of necessary documents, as applicable, while applying online and subsequently during submission of signed hard copies.
Background
As per Environmental Impact Assessment Notification, 2006 (“EIA”) an application seeking EC for building and construction projects must be made by the project proponent in Form 1, Form 1A and conceptual plan.
Further to that notification, the Ministry of Environment, Forest and Climate Change, through an Office Memorandum issued on 19th June, 2013 stated that for the purpose of avoiding delay in processing of proposals, project proponents must provide complete information at the first instance while submitting documents for obtaining EC.
Therefore, in order to provide guidance to the project proponent regarding requirement of documents for obtaining EC and to expedite the appraisal process for building and construction projects, two checklists, i.e. Checklist A and Checklist B have been prepared jointly by the SEIAA and the State level Expert Appraisal Committee (“SEAC”).
It is also pertinent to mention here that while appraising building and construction projects, SEAC will send their comments on Checklist B to SEIAA along with its recommendation.
