In a Notification dated 23rd September, 2019 issued by the Assam Pollution Control Board (“Board”), all industries generating and handling hazardous waste have been directed to submit their Manifest in Form-10 through the online portal of the Board’s website www.pcbassam.org under the link “online manifest for Hazardous Waste”.
This form extends to all industries generating and handling hazardous waste including recycling, co-processing, treatment and disposal.
Background
This has been introduced in pursuance to the case of Rajiv Naryana & Anr. Vs. Union of India & Ors. [O.A 804/2017] where the National Green Tribunal has ordered that all the States, where the hazardous waste is being generated to set up Treatment, Storage and Disposal Facility (TSDF) and monitor the compliance of the Hazardous & Other Waste (Management & Transboundary Movement) Rules, 2016 (“Rules”).
Submission of Manifest in Form – 10 emanates from Rule 19 of the Rules, which is a directive for the sender of waste.
The sender of waste must submit a manifest for Hazardous and Other Waste in Form 10 to the State Pollution Control Board for transporting hazardous or other wastes.
Purpose
This has been done by the Board to ensure effective implementation of the Rules and expeditious reconciliation of information regarding the movement of hazardous waste within the country.
