The Ministry of Environment, Forest and Climate Change has rolled out the Draft Environment (Protection) (Amendment) Rules, 2024 (“Amendment”) to further amend the Environment (Protection) Rules, 1986 and has invited objections or suggestions by 16th September 2024.
The Amendment prescribes for the Adjudication and Environmental Protection Fund Management and covers the following:
- Appointment of Adjudicating Officer
- Cognizance and Processing of matters
- Manner of inquiry by Adjudicating Officer
- Transfer of matters and proceedings
- Manner of service of notice for adjudication
- Appeals from the order of the Adjudicating Officer
- Factors to be considered while determining quantum of penalty
- Failure to pay penalty/ additional penalty impose by the Adjudicating Officer
- Amount to be credited in the Environment Protection Fund
- Utilization of amount of Environment Protection Fund
- Manner for crediting in the Environment Protection Fund
