The Government of Haryana has published the Draft Haryana Transgender Persons (Protection of Rights) Rules, 2024 (“Draft Rules”), with a view to implement the provisions of the Transgender Persons (Protection of Rights) Act, 2019. Public comments are invited on the Draft Rules by 19th March, 2025. Comments and suggestions may be sent to the Additional Chief Secretary to Government Haryana, Social Justice, Empowerment, Welfare of Scheduled Castes and Backward Classes and Antyodaya (SEWA) Department.
Key Highlights
- Transgender persons must apply for a Certificate of Identity through the Saral Portal. The District Magistrate shall issue the certificate within 30 days, allowing the applicant to update their name and gender on official documents;
- Employers are required to formulate and display an Equal Opportunity Policy, ensuring no discrimination in hiring, promotion, or workplace treatment;
- Establishments are required to designate a Complaint Officer to handle discrimination-related complaints within 15 days of receipt of the same;
- Infrastructure adjustments, such as unisex toilets and gender-sensitive facilities, are mandated to create an inclusive work environment;
- Any transgender person denied services or facing discrimination can file an appeal with the Appellate Authority within 90 days;
- Employers are required to maintain a tracking system to monitor compliance with transgender rights protection.
Employers or institutions failing to comply with non-discrimination and inclusion mandates may face governmental action and penalties.
