FSSAI mandates Form IX nominee updates and introduces auto-approval for Non-Form C modifications in FoSCoS

The Food Safety and Standards Authority of India (‘FSSAI’) has directed all Food Business Operators (‘FBOs’) to update the details of their Form IX nominees whenever there is a change in the designated individual. Additionally, FSSAI has introduced an auto-approval mechanism for Non-Form C modifications in the Food Safety Compliance System (‘FoSCoS’), streamlining compliance processes for food businesses. All FBOs are directed to strictly comply with these requirements and ensure that the authorities have accurate and current information about their food business operations.

Background:

FSSAI has observed non-compliance among several FBOs regarding the updating of Form IX nominee responsible for ensuring compliance with license conditions when the nominated person changes or leaves the company. As a result, the authority lacks up-to-date information on the person responsible for ensuring compliance, leading to outdated records with the authorities.

Key Highlights:

  • FBOs are required to notify the Licensing Authority whenever there is a change in the Form IX nominee, who is responsible for ensuring compliance with the conditions of the license;
  • FBOs must ensure that any material changes affecting their license—such as product category modifications, layout changes, business expansion, or closure are promptly updated with the Licensing Authority;
  • Failure to update nominee details or other relevant changes may attract penalties as per the law.
  • Effective from 12th February 2025, FBOs may modify Non-Form C details, including Form IX nominee information on FoSCoS without requiring prior approval or scrutiny from the concerned authority. This modification can be done without any additional fee.
