The Food Safety and Standards Authority of India (“FSSAI”) has issued a notice dated April 11, 2018 on the Draft Food Safety and Standards (Labelling and Display) Regulations, 2018 (“Draft Regulations”), inviting suggestions, views, and comments from the stakeholders within 9th June, 2018, i.e. 60 days from uploading of this notice on the FSSAI website.
The suggestions, views, objections and comments can be sent through post and addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, 3rd Floor, Food and Drug Administration Bhawan, Kotla road, New Delhi – 110002 or emailed to regulation@fssai.gov.in
FSSAI has also issued the format (attached for your reference) in which the suggestions, views and comments are required to be sent.
These Draft Regulations prescribe the labelling requirements of pre-packaged foods and display of essential information on premises where food is manufactured, processed, served and stored.
The key highlights of the Draft Regulations are:
(i) Regulation 4 states the general as well as specific requirements for labelling of packaged foods such as, the label should not be misleading or ambiguous and should indicate the true nature/ name of the food, list of ingredients used, nutritional values, declaration regarding food additives, FSSAI logo and license number, country of origin for imported foods, instructions for use etc.
(ii) Regulation 5 states that the information required under these regulations should be given on the principal display panel of the package or container and also specifies the manner in which such information is to be given.
(iii) Regulation 6 prescribes the mandatory declarations required wherever packaged food contains ingredients and /or additives as stated in schedule-IV of these regulations, the same shall be prominently displayed on the label. The size of numerals and letters for the declarations/ specific requirements specified in schedule-IV shall not be less than 3mm based on the letter l.
(iv) Regulation 7 lays down the exemptions from certain labelling requirements in cases where surface area of package is not more than 100 square centimetres, or where liquid products are marketed in bottles, or where food products have a shelf life lesser than 7 days, or where labelling requirements are provided in a Barcode/ Global Trade Identification Number (GTIN), or in case of imported packaged food consignments, or where primary food are imported in bulk etc.
(v) Regulation 8 states the labelling requirements in case of packaged food meant for non-retail sale. Regulation 9 specifies labelling requirements in case of packaged food additives for retail sale, whereas, Regulation 10 specifies labelling requirements in case of pre-packaged food additives meant for sale other than retail.
