The Ministry of Environment, Forest and Climate Change has notified the Battery Waste Management Amendment Rules, 2025 (“Amendment”) with immediate effect to amend the Battery Waste Management Rules, 2022 (“Rules”).
Key Highlights:
The following amendments have been made to the labelling requirements specified in Schedule I of the Rules:
- A new provision has been inserted which mandates Producers to provide the following information in writing to the Central Pollution Control Board (“CPCB”):
- Printed barcode or Quick Response code containing the Extended Producer Responsibility registration number on the following:
- battery or battery pack; or
- equipment having battery or battery pack; or
- packaging of battery or battery pack; or
- packaging of the equipment having battery or battery pack; or
- bulk packaging of batteries or battery packs, not for retail sale, and
- The Extended Producer Registration number printed on the product information brochure.
- CPCB has been directed to publish a list on its website of such PIBOs who have provided the details and update the same on a quarterly basis.
- The requirement of marking Battery or Battery packs with Extended Producer Responsibility registration will not apply in case of packaging which is covered under the provisions of the Legal Metrology (Packaged Commodities) Rules, 2011.
- Further, a proviso has been added mentioning that marking of chemical symbol ‘Cd’ or ‘Pb’ is not applicable where the metal concentration of Cadmium in the battery is less than or equal to 0.002% (20 parts per million) or Lead in the battery is less than or equal to 0.004% (40 parts per million) by weight.
