Compliances relating to High Fat Sugar Salt foods under the FSS (Fortification of Foods) First Amendment Regulations, 2020 to gain effect once HFSS food is defined under the FSS (Labelling and Display) Regulations 2020; clarifies FS

The Food Safety and Standards Authority of India (“FSSAI”) has issued a Notification reiterating that High Fat Sugar Salt (“HFSS”) shall be excluded from Fortified Processed Foods category as the same has not been defined under the Food Safety and Standards (Labelling and Display) Regulations, 2020.

In view of the above-mentioned, it has been clarified that compliances related to HFSS foods shall gain effect only when such foods have been defined under the Food Safety and Standards (Labelling and Display) Regulations 2020.

Background:

Upon receipt of representations from stakeholders seeking clarification regarding the exclusion of High Fat Sugar Salt (“HFSS”) foods from fortified processed foods under the Food Safety and Standards (Fortification of Foods) First Amendment Regulations, 2020 (“Regulations”), the Food Safety and Standards Authority of India (“FSSAI”) has issued the above clarification.
