Delhi HC orders NCT Delhi to file reply regarding concerns of treatment for patients in hospitals, the status of vacancy of beds and publication of data on COVID-19 testing

The Delhi High Court (Court) has issued an Order dated 9.06.2020, in the matter of Rakesh Malhotra (Petitioner) vs NCT of Delhi & Others (Respondents), [W.P.(C) 3031/2020].

The Order has been issued in pursuance of an application filed by the Petitioner seeking the following directions to be issued to the Respondents:

  1. To enlarge the number of laboratories that can undertake tests for COVID-19
  2. To make arrangement of proper treatment for COVID/non-COVID patients in hospitals
  3. To publish the correct data on their websites, in terms of the order dated 04.05.2020 passed in the petition.

Additionally, it was submitted by the Petitioner that hospitals/nursing homes who have been permitted to treat COVID-19 patients, must publish on their websites, the status of vacancy of beds on a daily basis so that patients are aware of the same beforehand.

For the first concern, the Court did not address any relief since the issue of testing of asymptomatic patients was already pending consideration.

With regard to other contentions, the Respondent was directed to file its response on the treatment for patients in hospitals, the status of vacancy of beds and publication of data on COVID-19 testing on its websites.
