Goa Factories (Seventeenth Amendment) Rules, 2024 notified; revises licensing fees, medical officer qualifications and application forms

The Government of Goa has notified the Goa Factories (Seventeenth Amendment) Rules, 2024 (“Rules”) to amend the Goa Factories Rules, 1985. The amendments, effective from 2nd January, 2025, reflect public comments received during the consultation period.

Key Highlights:

  1. Detailed scale of fees for licensing and annual renewals is introduced, categorized by the number of workers and horsepower used; online applications must process payments through the e-challan gateway, with an annual 5% increment in fees starting January 2025;
  2. Specific fees have now been prescribed for amendment of factories license in the following situations:
    1. For a change in the factory’s name or organizational status: five hundred rupees.
    2. For a change in the factory’s name due to acquisition or merger: five thousand rupees. The application for license amendment and notice of occupation must be submitted by the new occupier.
    3. For a revision in the site of the factory due to addition or deletion of premises: five hundred rupees.
    4. For a change in the manufacturing process, or addition or deletion of a process: five hundred rupees
  3. The qualification requirements of the factory medical officer which is to be appointed in the Occupational Health Centre stands revised. The qualification of three months certificate course in Associate Fellow of Industrial Health offered can now be either by the Directorate General of Factory Advice Services and Labour Institute (DGFASLI) Mumbai or an Institute approved by the Central Government/any State Government/Union Territory Administration, in accordance with the guidelines issued by DGFASLI.
  4. Form 1 for application for approval of plans to Construct, Extend or take into use any building as a factory or revision in plant and machinery layout or revision in site on which the factory is situated is now revised.
  5. Form 2 for application for registration and grant of license and/or notice of occupation or amendment of licence or transfer of license is now revised.
