Raj PCB reintroduces Special Dispensation Scheme for industries which are not yet under the consent management and are seeking Consent to Establish & Operate under the Water & Air Act; w.e.f. 01-08-20 to 30-10-20

The Rajasthan State Pollution Control Board (“Board”) has, recently observed that there are many industries processes/ projects/ activities etc who are not yet under the consent management and are seeking Consent to Establish and Operate under the provision of Water Prevention and Control of Pollution) Act, 1974 (“Water Act”)and the Air (Prevention and Control of Pollution) Act, 1981 (“Air Act”) for the first time.

Background:

In order to encourage such units to comply the provisions of the Water Act and Air Act, the Board had in past introduced Special Dispensation Schemes vide orders dated 22nd February 2012, 30th August 2013, 8th March 2018 and 14th September 2018. In continuation to that effort, the Board has decided to re-introduce it for a period of 90 days starting from 1st August 2020 to 30th October 2020 with the following conditions:

Key Highlights:

 The abovesaid industries should apply for Consent to Establish as well as Consent to Operate under the provision of Water Act and Air Act as per the prevailing procedure/ fee. However, as a onetime relaxation, such units will not be required to pay back fees for the year they were in operation so far.

 The industries covered under Red category or Large / Medium Scale under Orange and Green categories should apply for the consent as per existing provisions.

 The Group ln-charges and Regional Officers should dispose of all consent applications received under the Scheme within 120 days from the receipt of application.
