Karnataka Government extends conditional exemption for IT /ITeS companies from provisions under Industrial Employment (Standing Orders) Act till June 2029

In a recent Notification, and as a continuation to earlier Notification No. LD 194 LET 2016 dated 25-05-2019, the Government of Karnataka has exempted IT / ITeS / Startups / Animation / Gaming / Computer Graphics / Telecom / BPO / KPO / Other knowledge-based industries from the applicability of the Industrial Employment (Standing Orders) Act, 1946 for a further period of 5 years from the date of publication of the notification i.e., 10th June, 2024.

The exemption is contingent upon complying with following conditions:

  • Establish an Internal Committee as mandated under Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2019, to address complaints related to sexual harassment;
  • Constitute a Grievance Redressal Committee, comprising equal representation from both employers and employees, to address employee complaints and grievances in time bound manner;
  • Implementing an internal procedure to inform the concerned Jurisdictional Deputy Labour Commissioner about disciplinary actions such as suspension, discharge, termination, demotion, or dismissal of employees;
  • Providing information regarding the service conditions of employees to the concerned Jurisdictional Deputy Labour Commissioner and the Commissioner of Labour in Karnataka upon request..
