The Department of Fire & Emergency Services, Daman and Diu (“Department”), has in an Advisory dated 22nd May, 2019, reiterated the mandate to comply with the fire safety norms under the Goa, Daman and Diu Fire Force Act, 1986 (“Act”) and the Daman and Diu Fire Force Rules 2004 (“Rules”).
Background:
It has been noticed by the Department that various factories, establishment, storage place of flammable and hazardous goods and petroleum products have not obtained a fire NOC or complied with the fire safety norms.
Further, it has also been observed that industrial units have failed to keep the open set back spaces clear for passage, as per approved plan. The open spaces are stalked with inventory materials, the storage and structures are erected with plastic/ tarpaulin shed which are obstructing the entry of fire fighting vehicles to the industrial structure. Also, plastic/ tarpaulin is a fire prone material which causes fire to spread easily within premises or adjoining industrial units.
Given the present background, the Department mandates the said units to apply for the fire NOC, comply with the fire safety measures within three months from the date of receipt of this advisory (i.e., within 22nd July 2019) and ensure that no temporary structure is erected in open set back spaces keeping them free from obstruction and encroachment.
Failing to comply with the above directions will lead to the following consequences:
- Premises will be declared unsafe from fire safety point of view
- Punitive/penal action will be imposed under the provisions of the Act and the Rules.
- Seizure, detention and removal of objects / goods likely to cause risk of fire.
