Haryana Government amends the Haryana Lifts and Escalators Act, 2008; casts obligation on owner of high rise building (more than 15 meters in height) to install emergency rescue device

The Haryana Government has notified amendments to the Haryana Lifts and Escalators Act, 2008 (“Act”) through the Haryana Lifts and Escalators (Amendment) Act, 2020.

The amendments are as follows –

Section 2 “Definitions” after clause (a), new clause (aa) has been inserted (Not present in Principal Act) (aa) “emergency rescue device” means an electronic and electric apparatus which provides 3-phase emergency power supply to the lift, in case of power failure / breakdown in the high rise building and gives sufficient backup to the lift to land, stop and open the landing and lift cage doors at any floor and remain in regular operation upto the extended time which would be at least fifteen minutes. New definition of “emergency rescue device” has been introduced.

 

Emergency rescue device supplies emergency power to lift so that basic functions of lift like opening / closing of doors, stopping of lift etc. may be carried on in cases of power failure/breakdown in the high rise buildings.

 

Section 5 “Automatic rescue Device” The owner shall make arrangement to provide for an automatic rescue device to rescue the travelling passengers trapped in the lift in the event of breakdown of power supply by bringing and stopping the lift at the nearest landing floor and keeping the landing and lift cage doors open. Emergency rescue device and automatic rescue device.-

(1) The owner shall make arrangement to provide the emergency rescue device for high rise building having height more than fifteen meters excluding group housing, domestic or any other building to rescue the travelling passengers trapped in the lift in the event of breakdown of power supply by bringing the lift to any floor, stopping the lift and keeping the landing and lift cage doors open.

 

(2) The owner shall have option to provide automatic rescue device or emergency rescue device for group housing building, domestic or any other building having height less than fifteen meters to rescue the travelling passengers trapped in the lift in the event of breakdown of power supply by bringing the lift to nearest/any floor, stopping the lift and keeping the landing and lift cage doors open, as the case may be.

The owner of high rise building (more than 15 meters in height) now has to provide “emergency rescue device” so that passengers trapped in a lift can be rescued in the event of breakdown of power supply by bringing the lift to nearest / any floor, stopping the lift and keeping the landing and lift cage doors open as opposed to earlier requirement to provide “automatic rescue device” for lifts during power failure etc.

 

The owner will now have the option to provide automatic rescue device or emergency rescue device in any building less than 15 meters in height.
