Here is a note on things to be careful about when celebrating Holi 2022

  1. If any action causes any injury, danger or annoyance to the public, then the provision on Public Nuisance under Section 268 of the IPC may be invoked;
  2. Any obscene act including singing or playing songs with obscene words, in a public space may attract the provision on Section 294 of the IPC;
  3. Any bodily pain, disease or infirmity caused to any person may invite punitive action under Section 319 of the IPC;
  4. Any gesture which causes any person to apprehend that the person doing such gesture is about to use criminal force on that person, is said to commit an assault and as a result, the provision of Assault under Section 351 of the IPC may be invoked;
  5. If a person intentionally uses force on any person, without consent, in order to cause injury, fear or annoyance to the person may be subject to punishment under Section 350 of the IPC;
  6. If a person uses assault or criminal force against a woman with the intention or knowledge that it will outrage her modesty, it may invoke the provision under Section 354 of the IPC;
  7. Any physical contact and advances involving unwelcome and explicit sexual overtures or demand or request for sexual favours or making sexually coloured remarks may attract the provision on Prevention of Sexual Harassment under Section 354A of the IPC.

 

In case any of the above-mentioned activities, an FIR can be lodged and accordingly, action can be taken against such person.
