In absence of Indian Standards, PPEs must conform to EN (European standard) or ANSI (American National Standards Institute) or ISO; comments invited to Gujarat Factories Rules

The Labour and Employment Department of Gujarat (“Department”) has published the draft Gujarat Factories (Amendment) Rules, 2021 (“Draft Rules”) which proposes to further amend the Gujarat Factories Rules, 1963 (“Rules”).

Suggestions or objections on the Draft Rules have been invited from stakeholders. Comments may be addressed to the Additional Chief Secretary, Labour & Employment Department, Sachivalaya, Gandhinagar.

The proposed changes to the existing Rules has been tabulated below for ease of reference:

All personal equipment provided to workers as required under any of the provisions of the Acts or Rules shall conform to the relevant Indian Standards, if any or in the absence of it, personal protective equipment shall be approved by the Chief Inspector of Factories:

Provided that the PPE’s not having relevant Indian Standards or not having approval from Chief Inspector of Factories, shall be required to compliant with EN (European standard) or ANSI (American National Standards Institute) or ISO (International Organization for Standardization), as the case may be, modified from time to time till the relevant Indian Standard is made available.

It is proposed that all PPEs need to be approved by the Chief Inspector of Factories in the absence of relevant Indian Standards.

Further, the PPE’s for which relevant Indian Standards or approval from Chief Inspector of Factories is not there, shall be required to be compliant with EN (European standard) or ANSI (American National Standards Institute) or ISO (International Organization for Standardization), as the case may be, modified from time to time till the relevant Indian Standard is made available.

 

Note: We have not been able to locate the Draft Rules in the Gujarat Official Gazette. The last date for submission of comments/ suggestions for the above-mentioned is 45 days from publication in the Gujarat Government Gazette.
