MEITY gives immediate effect to Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021; supersedes the Information Technology (Intermediaries Guidelines) Rules, 2011

The Ministry of Electronics and Information Technology has notified the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“2021 Rules”) under the provisions of the Information Technology Act, 2000. The 2021 Rules supersede the Information Technology (Intermediaries Guidelines) Rules, 2011.

The 2021 Rules have gained effect immediately.

Key Highlights:

  • Grievance Redressal Officer to acknowledge complaint within twenty four hours and dispose of complaints within a period of fifteen days from the date of receipt;
  • Prescribes additional compliances for Significant Social Media Intermediaries;
  • Prescribe three-tier structure to ensure compliance with Code of Ethics and for addressing grievances;
  • Significant Social Media Intermediaries, publishers of news/ online curated content to publish monthly compliance report mentioning details of grievances received and action taken.
