Ministry of Environment, Forest and Climate Change notifies the Environment (Construction and Demolition) Waste Management Rules, 2025; effective from 1st April, 2026

The Ministry of Environment, Forest and Climate Change (“MoEFCC”) has notified the Environment (Construction and Demolition) Waste Management Rules, 2025, superseding the Construction and Demolition Waste Management Rules, 2016, which shall come into force with effect from 1st April 2026. These rules shall apply to all activities of construction, demolition, remodelling, renovation and repair of any structure.

Key Highlights:

  • The Rules provide for Extended Producer Responsibility (“EPR”) Framework for all Producers as defined under the Rules and specific provisions regarding registration of entities, generation and transaction of EPR Certificates and modalities of the EPR framework.
  • A separate chapter on utilization of processed waste which mandates implementation of a framework for utilization of processed waste in all construction activities having built-up area of 20000 sq. mts. and above, and road construction. A detailed description on the manner in which the framework must be implemented has been included.
  • Establishment of intermediate waste storage facilities by local authorities or development authorities, until recycling facilities become operational. Producers will be required to deposit their waste in these facilities.
  • Dedicated provisions outlining the specific responsibilities and duties of a Waste Generator, Producers, Recyclers, Contractors, Service Providers and Authorized Agencies and other entities.
  • Provision for levying of Environmental Compensation (“EC”) by the Central Board in accordance with the Rules.
  • The entities registered under the extended producer responsibility framework shall be required to furnish information on the portal for collation of data on receipt, storage, recycling and dispatch of waste during preceding half year by October 15 and April 15 each year.
  • According to the new Rules, manager or in charge of the entity, in case of any accident during collection, transportation, storage or processing of waste, shall report immediately or within 24 hours about the incident to the State Board through telephone and e-mail.
  • Additionally, Schedules specifying the Targets for recycling of waste as per EPR framework, Minimum targets for utilisation of waste in construction and re-construction activities as per Waste Utilisation Framework for building construction, Minimum targets utilization of waste in road construction have been included.
