MOHFW includes Nebulizer, Digital Thermometer, BP monitoring devices and Glucometer within the purview of “drugs”; provisions gain effect from 1st January, 2020

The Ministry of Health and Family Welfare (“MOHFW”) has through a notification dated 3rd December, 2018, specified the devices intended for use in human beings for internal or external use in the diagnosis, treatment, mitigation or prevention of disease or disorder in human beings or animals, to be included in the definition of drug under the Drugs and Cosmetics Act, 1940; effective from 1st January, 2020.

The devices specified are:

(i) Nebulizer;

(ii) Blood Pressure Monitoring Devices;

(iii) Digital Thermometer; and

(iv) Glucometer
