Rajasthan Pollution Control Board issues information regarding CTO/CTE for textile units

The Rajasthan State Pollution Control Board (“RSPCB”) has issued an Office Order in order to expedite the disposal and to streamline the process partial modification of previous orders (described below), in respect of delegation of powers for grant/ refusal of CTE/CTO for textile units is issued and will be as under:-

1. The power to Grant/Refusal of consent to establish/consent to operate of textile units connected to CETP & having discharge upto 100 KLD will be with Regional Officers of the State Board including applications for change in plant & machinery and transfer of plant and machinery

2. All such Textile units located in textile cluster of Pali, Jodhpur and Barmer where closure direction/revocation/refusal have been issued till 30.11.2020 shall be processed/decided on merit by the Regional Officers.
The present Order has gained effect immediately.

Background:

For textile units, the power to grant/refuse CTE/CTO under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air Prevention & Control of Pollution) Act, 1981 has been delegated to Regional Officers as under:-

1. Yarn/textile processing involving any effluent/emission generating process, bleaching, dyeing, printing and scouring located in cluster (having discharge upto 100 KLD and are connected with CETP).

2. The office order further pointed that in case any application is refused at the Regional Office level, the decision on the application submitted subsequently by the unit will be taken by at RSPCB, Head Office level. However, the consent applications submitted after refusal on grounds of deficient documents will continue to be decided by the concerning Regional Office.
This has been informed by the RSPCB through an Office Order dated 15th July, 2020.
Subsequently, the RSPCB has issued Order for Grant of Consent for change of plant and machinery/product/ process in textile processing plants which are member of CETP and office order dated 15th July, 2020 (mentioned above) for issuance of permission for transferring plant & machinery from one industrial unit to other industrial units (which are connected with CETP). In both these orders it has been directed that consent for change of plant & machinery shall be granted by Head Office only.

Thereafter, in order to expedite the process, the present Order has been issued.
